隨著近年來自由開源軟體發展的成熟與穩定,對於許多國內企業來說,應用自由開源軟體來加速產品開發,已經成為一個不可逆的時代趨勢。然而自由開源軟體在授權模式上,不同於傳統的封閉源碼軟體,在應用管理層面也因此應有所不同,許多企業因為不熟悉自由開源軟體的特性與管理方式,而有許多的困擾,甚至後續於司法實務上衍生了法律糾紛。針對此,講者將以自由開源軟體的應用特性與授權內容為開場,說明自由開源軟體與過去傳統封閉源碼軟體的不同之處,並引述在加入商業產品開發時所可能產生的問題,接著提出建議的自由開源軟體應用管理流程,包括:程式碼管理、軟體清單遞交制度的建立等等,透過這些管理流程的介紹,期望裨益國內企業在應用自由開源軟體時,能有效的降低與管控可能產生的法律糾紛與風險。
Many Free and Open Source Software (FOSS) projects have been largely improved both in maturity and stability in recent years. Accompany with that, implementing FOSS to speed up the manufacturing circle of products is an irreversible tendency for most companies in Taiwan. However, FOSS is different from traditional proprietary software in licensing model, hence, to comply with its licensing rule, the in-house governance policy should also be changed. But till now, many Taiwan companies are still not familiar with the first thing about the FOSS governance at all, this kind of recklessness would build up a barrier from implementing FOSS projects properly, it might even cause legal disputes in the long run. Responding to that, speaker of this session will start this talk with a description of FOSS licensing characteristic, its content, obligation, and the differences from proprietary software. Following that, the issues arising when implementing FOSS in commercial product will be discussed. After that, the governance flowchart of FOSS management process will be introduced, this topic includes Source Code management method and software list inheritance mechanism. Finally, the rationale of the governance flowchart will be explained. The speaker hopes all the audience can get a better understanding of the flowchart, and help them to reduce and control the infringement risks on FOSS implementation in the future.
林誠夏 (Lucien Lin) ,網路暱稱為 “Lucien” 或 “lucien.cc”,知識背景為科技法律,但是也喜歡學習任何新奇有趣的事物。自2005年開始任職於中央研究院自由軟體鑄造場,踏入自由軟體授權條款的研究領域,並專職於自由軟體授權條款的解說分析,以及自由軟體商業運用模式的觀察記錄。2008年開始擔任自由軟體鑄造場的專案經理,2010年兼任電子報主編,目前已卸下這二份職務,改戮力於個人的書籍寫作並轉任計畫維運發展的諮詢顧問。
Lucien C.H. Lin, the frequently used id of him in the internet is “Lucien” or “lucien.cc”. His education background is mainly in the field of technology laws, but he also has many interests and is inclined to learn anything of novelties and creativities. In 2005, he stepped in the study area of “Free and Open Source Software (FOSS)” licenses and became an academia research member of the “Open Source Software Foundry (OSSF)” project. Since then, he is in charge of the analysis and interpretation of FOSS licenses, the record and track of FOSS business trends and models. He served as the project manager of OSSF project in 2008, and the OSSF newsletter chief editor in 2010. He retired both of the positions in 2011, and shifted his role in OSSF as a management advisor. Now he devotes himself to the writing of the coming book “Understanding Free and Open Source Software Licensing as Business Intelligence” to help Taiwan people to get a better and useful understanding on FOSS licensing.
